*We have screened a lot of questions regarding the cannabis laws.  Although cannabis is considered legal in certain circumstances – it is still illegal if not purchased at a licensed dispensary (unless covered by the Medical Marijuana Act) and is illegal if “open” or consumed in a vehicle. You cannot buy from your local dealer, you cannot smoke while you drive down the street, and you cannot walk around town and smoke. All of these violations are subject to ticket or arrest and may get your vehicle towed. Yes, we do use a lot of discretion and not enforce in these situations, however, if you are high or under the influence of cannabis and driving a vehicle, we likely will arrest you and tow your vehicle – as this is a public safety issue.

*Note: 625 ILCS 5/11-502.15 9 (See full law for all rules and exceptions.)

*Sec. 11-502.15. Possession of adult use cannabis in a motor vehicle:

(a) No driver may use cannabis within the passenger area of any motor vehicle upon a highway in this state.

(b) No driver may possess cannabis within any area of any motor vehicle upon a highway in this state except in a secured, sealed, or resealable, odor-proof, child-resistant cannabis container that is inaccessible.

(c) No passenger may possess cannabis within any passenger area of any motor vehicle upon a highway in this state except in a secured, sealed or resealable, odor-proof, child-resistant cannabis container that is inaccessible.

(d) Any person who knowingly violates subsection (a), (b), or (c) of this Section commits a Class A misdemeanor.
